Terms of Service

These Terms govern your use of the freight quote, approval, and payment services at freight.horizonpacknship.com(the “Service”), operated by Horizon Pack and Ship LLC (“Horizon,” “HPNS,” “we”). By submitting a quote request or approving a shipment, you (“Shipper”) agree to these Terms.

1. Who we are

HPNS is a Kentucky LLC operating freight brokerage services through C.H. Robinson Worldwide, Inc.'s Freightquote platform under customer code C8903030. C.H. Robinson is the licensed motor carrier broker of record on the Bill of Lading for shipments we arrange. HPNS is not a motor carrier and does not directly transport freight.

2. Quote requests

You may request a freight rate by submitting the form on the Service. Quotes are:

  • Non-bindinguntil you affirmatively approve them by clicking “Approve and Pay” on the quote page and completing payment
  • Valid for the period shown on the quote (typically 7 days). Expired quotes must be re-requested; rates may differ
  • Based on the shipment details you provide. If actual weight, dimensions, freight class, or accessorial services differ at pickup, the carrier may adjust the rate per their tariff and you remain responsible for the difference
  • Subject to carrier availability. Carriers may decline a tender after quoting; in such cases we will attempt to re-source the load and notify you of any rate change before proceeding

3. Approval and payment

Payment is required before we dispatch your load. By approving a quote you authorize Intuit Payments Inc. to charge the bank account or card you provide for the all-in rate displayed, including any accessorial surcharges and applicable processing fees disclosed on the payment page.

Credit card payments include a 3% surcharge passed to the Shipper. ACH/eCheck payments do not incur a surcharge. Surcharge disclosure complies with Kentucky and card-brand requirements.

Once payment clears we will book the load with the selected carrier. You will receive a Bill of Lading and pickup confirmation by email.

4. Cancellations and refunds

You may cancel a booked shipment by contacting us at support@horizonpacknship.com or (270) 900-1553. Refund eligibility depends on carrier dispatch status:

  • Before carrier dispatch: full refund minus any payment-processing fees already incurred
  • After carrier dispatch but before pickup: refund less the carrier's dispatch / dry-run / TONU (Truck Order Not Used) fee, typically $150–$500 depending on lane
  • After pickup: cancellation may not be possible; freight in transit must be redelivered or returned at additional cost

Refunds are issued through Intuit Payments to the original payment method.

5. Accessorial services

Accessorial services (liftgate, residential delivery, inside delivery, appointment, hazmat handling) are charged as additional surcharges disclosed on the quote. If accessorial services are required at pickup or delivery but were not selected at quote time, the carrier may add the charge to the invoice and you remain responsible for the difference.

6. Cargo loss and damage

Carrier liability for loss or damage is governed by the National Motor Freight Classification (NMFC), the carrier's rules tariff, and applicable federal law (49 U.S.C. § 14706, the Carmack Amendment). Standard LTL liability is typically limited per pound by NMFC class; for high-value freight, declared value coverage is available at additional cost and must be elected at quote time.

Reporting damage: visible damage must be noted on the delivery receipt before signing. Concealed damage must be reported within 15 calendar days of delivery. Our team will file and manage the claim with the carrier on your behalf, but settlement is determined by the carrier under its tariff and applicable law.

7. Shipper representations

By submitting a shipment you represent that:

  • The freight is properly packaged, marked, and labeled per 49 CFR and the carrier's requirements
  • Hazardous materials are correctly classified, declared, placarded, and accompanied by the required shipping papers (49 CFR Part 172). Undeclared hazmat is a federal offense
  • You have authority to ship the freight and are the lawful owner or authorized agent of the owner
  • The weight, dimensions, and commodity description you provide are accurate. Reweigh or reclass charges resulting from inaccurate information are your responsibility
  • You comply with all applicable export controls (EAR, ITAR, OFAC) for international shipments

8. Limitation of liability

To the maximum extent permitted by law, HPNS's total liability arising out of or relating to your use of the Service is limited to the markup amount HPNS retained on the specific shipment in question (the difference between the all-in rate you paid and the carrier's actual charge to HPNS).

HPNS is not liable for cargo loss or damage in transit; the carrier is the liable party under the Carmack Amendment and its tariff. HPNS is not liable for indirect, consequential, special, or punitive damages including lost profits, lost business, or lost data.

9. Federal and government shipments

If you flag a shipment as Federal/Government, the three-carrier comparison quote PDF we generate is intended to support your agency's FAR Part 13 simplified-acquisition comparison-quote documentation. The PDF is informational; the awarding agency's contracting officer is solely responsible for compliance with applicable FAR clauses and agency-specific supplements (DFARS, VAAR, etc.).

10. Force majeure

Neither party is liable for failure or delay caused by circumstances beyond reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, government action, severe weather, or carrier network disruptions.

11. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Kentucky, excluding conflict-of-laws principles. Any dispute not resolved through good-faith negotiation will be brought exclusively in the state or federal courts located in Hardin County, Kentucky, and you consent to that jurisdiction. Nothing herein limits either party's right to seek injunctive relief in any competent jurisdiction.

12. Indemnification

You agree to indemnify and hold harmless HPNS, its officers, employees, and agents from any claim arising out of your breach of these Terms, your misrepresentation of shipment contents (especially undeclared hazmat), or your violation of applicable law.

13. Changes to these Terms

We may update these Terms. Material changes will be reflected in the “Last updated” date at the top. For shipments quoted and approved before an update, the prior Terms govern. Continued use of the Service after an update constitutes acceptance.
